TERMS AND CONDITIONS OF BUSINESS:

Premier Homes Direct runs a website to host property advertisements and by submitting your property details to us for publication you are indicating that:

You are the legal owner or an agent acting on behalf of the legal owner of the property with the sole right to sell or rent.

You give permission for Premier Homes Direct to publish the details of your property on your behalf.

To the best of your abilities, the details supplied by you are a TRUE and ACCURATE reflection of your property and not misleading in any way.

Copyright

You agree to grant a copyright license to Premier Homes Direct for property details submitted on this site by you as owner, landlord or agent.

All graphics, images and all other site content displayed are copyright of Premier Homes Direct and may not be reproduced without our written consent, though you may print or save property details for personal use via the buttons provided on each property details page.

Security and privacy

You agree that we may use any personal data, which you have provided to perform the service you have requested of us. We undertake to not knowingly pass on your personal data to any third parties without your prior consent.

You must treat all information, which you receive from interested parties in accordance with the Data Protection Acts 1984 and 1998 (whichever applies).

Site content

We may update the information on the website regularly and make every effort to ensure this information is accurate, however we do not guarantee it.

All material contained within this website is posted in good faith. Only material entered by the client is displayed for inclusion in their advertisement and we take no responsibility for its accuracy. We reserve the right to delete or edit any descriptions or information, which we know or believe to be false or misleading.
We have the right not to publish any material, which in our opinion may be of an illegal, offensive or defamatory nature, or an infringement of copyright, patent or any other rights of any third party.

The client shall indemnify Premier Homes Direct in respect of any claim, costs and expenses arising out of any defamatory matter or any infringement of copyright, patent, and design or of any other personal rights that we may incur as a result of any material placed by the client.

You are responsible for

All arrangements made with any interested parties to either buy or rent your property, whether they are on-line or off-line.

Ensuring that you always keep us informed so that your property page content is always authored in a clear and concise manner, free of errors, spell checked and kept up-to-date.

Keeping your property current and marking its status appropriately. We will remove a property for a client if instructed to do so, however we reserve the right to remove the property at a time that is convenient to us.

Limitation of liability

The client cannot hold Premier Homes Direct liable for any possible loss of custom due to server, network or website downtime.

We cannot accept responsibility for any alterations caused by third party action occurring to the client's pages once placed. Such alterations include, modifications or deletions.

We make no claim that we can find a buyer or tenant for any client and will not be involved in any negotiation between interested parties.

Should you decide to buy or rent any property advertised on our website, then the terms of such transaction will be between you and the seller, landlord or agent and entirely at your own risk. You will have no contractual relationship with us.

We always recommend that when dealing with property you seek independent financial and legal advise and act upon it accordingly.

Governing Law

These terms of use and any matter relating to the use of this website shall be governed and construed in accordance with the laws of England and Wales. Any dispute relating the use of this website will be subject to the exclusive jurisdiction of the courts of England and Wales.

Agreement

Premier Homes Direct always acts in good faith, but reserves the right to change, at any time, the terms and conditions of using this website and the acceptance of hosting client's advertisements. If the terms of use change, we will inform users of the website by placing a clear visible statement to that effect.

This Agreement constitutes the entire agreement between the client and us and it supersedes any communications and proposals, whether oral or written, between
Premier Homes Direct and the client.

Our Fees (All INCLUSIVE of VAT)

If you sign up to advertise your property(s) for sale or rent with Premier Homes you are able to choose from two fee options. Either,

OPTION 1: A one off fee of £499 payable when you have approved the property marketing details that we will draft for your authorisation. When this fee is paid Premier Homes will upload your property marketing details onto www.PrimeLocation.com. If you choose this option, no further fees or COMMISSION are payable on sale. (If advertising a property for rent our fees are £199)

OR choose

OPTION 2: A fee of 0.5% of the sale price which is only payable should you sell your property through an inquiry introduced by us. This fee would be payable on completion of your sale.
A purchaser (or property renter) will be considered to be 'introduced' to you if at any time unconditional contracts for the sale or rent of your property are exchanged with a purchaser (or property renter) who we introduced to you by way of contacting you directly by email/post or telephone with the purchaser's (or property renter's) name and/or contact details.
If you select Fee Option 2, you acknowledge and agree that you will instruct your solicitor or other legal representative to pay the fee due to Premier Homes on the date of completion. Interest will be charged on any outstanding sum at 4% over the Royal Bank of Scotland base rate and will run from the date of completion should the account not be settled within 7 days of legal completion for the sale or rent of your property.
Please note that Fee Option 2 is not available for advertising Property(s) for rental.

FOR SALE BOARDS: We can supply you with a Premier Homes For Sale board (which we recommend that you have) for £30.
